Shivaji Chowk, Malad East, Mumbai – 400 097, Maharashtra, India. The use of our Web site shall be governed by these Terms and Conditions (“these Terms”) as mentioned below. We request the User’s (“you” / “your” / “customer” / “User”/ “traveller”) to read and follow these Terms carefully. Use of the services provided on this Website constitutes your binding obligation and agreement to all such terms, conditions, and notices which are subject to amendment without any notice by us. In case these Terms are not acceptable by you, we regret that we shall not be in a position to provide any services to you and further request you to kindly exit this Web site.

USAGE

The use of any material / content / information / images / videos / music / graphics / Presentations / blogs by you shall be limited to personal and non-commercial use only. You will not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this Web site.
Unauthorized use of any of the content available on our website shall invite legal implications purely at your cost and expenses.

OFFERS

All offers / quotes / packages available on this Web Site are solely for the purpose of furnishing an outline of the travel plan. Any booking shall be made with us only when the Traveller confirm the same with us by a way of a specific and express request. We further reserve our right to accept or reject such request on reasonable grounds. Any offer available on the Web site does not bind us in any manner whatsoever. We reserve the right to make changes to the offers / quotes and packages available on the Web site at any point of time. However, you may feel free to communicate and make enquiries with us for further clarity on any offer prior to making a booking.

BOOKINGS

A booking with us shall be confirmed only when all reservations details and confirmations are communicated to us by email. The booking shall be made subject to the following conditions:

We do not guarantee any availability on hotels / airlines / other services mentioned in a quoted offer.
Requests for room types will be honoured based on availability at the requested hotels. We encourage you to make such bookings at the earliest.
Triple room accommodation is subject to availability at the time of booking. You are required to be mindful that the meaning and definition of a “triple room accommodation” differs from country to county and it shall depend on where you intend to travel. For the said purposes, a triple room may also mean a double or twin room in which the hotel will add a second or third bed (roll-out) or a sofa or a cot at the expense of comfort and space, even for the third adult. You shall not have any right to claim discount or compensation if dissatisfied with such arrangements.
During the process of booking and finalizing your itinerary, you will be required to share a scanned copy of your Government approved ID cards with us by email.

PAYMENTS

All payments shall be made in accordance with the payment schedule provided by us at the time of confirmation of the booking. The payment schedule shall be specially curated suiting the nature of your trip. The schedule shall contain the details of tranche payments, the date on which the payments shall become due, cancellation charges and other such cots. The payment shall be accepted only in Indian Rupees as per the prevailing rate of exchange on the day of the quote by a way of Bank Transfers, Cheques or Credit and Debit Cards. Payment in any other currency shall be accepted only after prior approval from us. You will be required to make all payments as per the payment schedules and the due date mentioned therein. In case such full amount is not received by us, we reserve the right to cancel the booking/registration with consequent forfeiture of deposit and the deduction of cancellation charges. For booking requests for any last-minute booking, you will be required to make complete payment to confirm the same.
We make payments to other hotel / airlines and other such services on your behalf and would be rendered helpless in case you fail to provide the payment on time. Our team shall keep you updated from time to time regarding the same. In case of any other additional charges required, we shall intimate the same to you well in advance and shall provide an updated payment schedule to you.

CHANGES

We further reserve the right to alter or amend your travel plan and itinerary up until the availing of such services on reasonable and valid ground beyond our control. We shall endeavour to provide the next best alternative at the same level to such cancelled service. Such a change shall be intimated to you well in advance. In such a case, you shall not be entitled to claim any discount / reduction / refund / compensation.

SPECIAL REQUESTS

All special aids / assistance required in case of any medical needs shall be informed at the time of booking. Any further requests such as adjacent or connecting rooms, bedding requests, smoking rooms and special dietary needs should be advised at time of booking. Please note that reasonable efforts will be made to secure special requests; however, they cannot be guaranteed.

PRICE AND OTHER CHARGES

Published prices may be modified due to unexpected significant external factors not forecasted at the time of printing the invoice. Any increase due to changes in government laws, i.e., tax changes, will be added to the invoice. Any increase in airfare, airport taxes, visa charges, fuel surcharges, and other such transportation fee after the booking/registration will have to be paid and borne by you. For the purposes of international travel, all rates shall be based on exchange rates in effect on the date of confirmation by you. In case of fluctuation in the currency rate, the impact would be fully passed on to the traveller.

INSURANCE

The bookings made with us shall not be inclusive of the Travel Insurance. However, we may arrange for providing of such insurance, the cost of which shall be borne by you. You may also choose to purchase a comprehensive personal travel insurance policy for the duration of the trip to cover against Personal Accident, Loss of Baggage, Delays, Unexpected Alterations to Travel Arrangements, Cancellation, Act of God, Emergency Medical Evacuation, Infectious diseases, Epidemics, Terrorism, etc.

CANCELLATION

You will be required to make all cancellation in writing only. The date of the receipt of such written notice shall be considered as the date of initiation for the calculation of cancellation charges. The cancellation charges shall be based on the nature of bookings made by you and shall be provided to you well in advance in the payment schedule provided to you.
Any modification or amendment to the trip shall be treated as a cancellation of the earlier booked trip and the cancellation charges as mentioned in the payment schedule shall be applicable. You will be required to intimate of such modification requests at the earliest to prevent unnecessary hassle and cost to you. We shall try our best to accommodate your requests in the remaining time and in case any extra modification charges are required to be paid then the same shall be borne by you. Please note that any modification to the air-fare booking shall be subject to applicable change / reissue charges as per the concerned airline’s fare rules under which your booking has been made.
In cases the modifications requested by you are in the nature of activities / hotels / guides / tours during the course of your trip, you shall be required to bear any applicable supplier / partner expenses. During the course of the trip if any service already booked by you is not availed by you for any reason whatsoever, you shall not be entitled to claim refund for the same.

REFUNDS

All refunds shall be made in compliance to these Terms and Conditions herein. Please note that all bookings made with other suppliers shall be subject to their terms and conditions as well and the same shall be binding on you as well. In case of air tickets, refunds shall be permissible only as per the fare rules under which your bookings were made.

VISA, PERMIT & TRAVEL DOCUMENTS

Additional paperwork shall be required in case of international destination being Visa, Permit, Vaccination Certificate, Insurances and the likewise. We shall inform you on the list of documents which shall be needed as per your chosen destination. You may choose to procure those documents on your own or may request us to do the same for you. Please note that all such documentation work carried out by us on your behalf shall be at your cost and expenses.
The preparation and procuring of all such documents shall be outsourced to third parties by us and we shall not be responsible for any delay / failure to issue on their part. You will be required to ensure the following at your end:

Ensure that your / travellers’ passport valid for at least six (6) months from the date of entry into the country of destination.
Ensure and Check your / travellers’ details on all documents like name, age, spelling of the name etc. are all appropriately mentioned. The client’s name and details must be completely accurate and match the information on the passport.
Ensure that all documents are compiled and kept ready prior to the departure of the travel.
In case any documents are missing, and you require us to prepare the same for you, then intimate the same to us within reasonable time. We shall not be responsible to arrange anything in the last minute.

REMOTE AND SENSITIVE AREAS

We strive to provide you with unique trips which includes wildlife sanctuary, remote location camps, village stays, Houseboats, Cruises, Remote Islands and other such similar place. Please note that the resources available in such places are not within our control. You shall not hold us responsible in any manner for the availability of quality lodging, quality food, internet connection, electricity, means of communication, personal safety, local transport facility, availability of medical and health services, climate, whether, wildlife, health concerns and other such risks associated with the place you wish to travel. At the most, we shall apprise you about the possible risk and the precautionary steps that you must take during your such trips. However, we shall in any manner not be responsible for any loss to life, limb or property that may be or that is caused to you / traveller / any third party due to your actions on account of any foreseen and / or unforeseen circumstances.

ACTIVITIES OF THRILL AND ADVENTURE

During the course of your trip, you may also avail activities of Thrill and Adventure like Safari Trips, Underwater water activities, Water sports, Aerial Sports, activities involving motor vehicles, activities around or within the wildlife, treks and the likewise. Such activities shall be planned and organized only upon your express request and consent. We shall book these activities with third parties on your behalf and you will be required to follow all the instructions given to you by them directly or through us. Please note that all such activities always come with a risk associated with it and in case any discomfort, harm, injury, liability or loss is caused to you, then we shall not be held responsible for the same in any manner whatsoever. By requesting us to book such activities on your behalf, you shall effectively waive your right to hold us responsible of any result as a consequence of those activities. Furthermore, in case you choose to not avail such services despite having booked the same, no refund shall be payable to you.

TRAVEL INCLUSIONS

Unless expressly mentioned in your travel itinerary, the package booked shall not include airfares and airport taxes of any nature, both domestic and international; excess baggage charges as imposed by airlines; forwarding or courier of baggage and purchases; passport and visa cost; camera charges; emergency evacuation charges, medical charges for inoculations; room service; tour charges; hotel porters; intra city transfers; sightseeing tours etc. You are requested to please go through each and every package individually and apprise yourself on the exclusions and inclusions of that package. We shall be happy to arrange something beyond the inclusions upon express request by you which shall be charged separately.

LIABILITY

All the information provided on this Web Site if to the best of our knowledge and is published in good faith. We do take all reasonable steps in ensuring that the maintain a set standard and a service that is acceptable to you / traveller. Having said that, we shall not be held liable for the following:

Any changes / cancellation / extra charges towards the services availed from the third-party service providers which are neither controlled nor owned by us.
Any loss of documents / luggage / property during the course of your trip.
Any loss, injury or damage to property, personal accidents, delays, irregularities or any such occurrences due to an event which we even with all due care could not foresee or foretell.
Any consequence due to Force Majeure.

INDEMNITY

You hereby agree to indemnify, defend and hold harmless Roam Eazy Holidays, its affiliates and their respective officers, lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by such indemnified persons, that arise out of, result from, or may be payable by virtue of, any breach of any representation or warranty provided by the User, or non-adherence of any covenant by you.
We reserve our right to hold or forfeit the refund if it found that you are violating any of the T&Cs.

FORCE MAJEURE

An event of force majeure is an event or circumstance which is beyond the control and without the fault or negligence on our part and which by the exercise of reasonable diligence we were unable to prevent. Such an event may be including, but not limited to acts of God, war, threat of war, riot, civil strife, strikes, terrorist activity (actual or threatened), acts of foreign invasion, insurrection of military or usurped power, civil rebellion, revolution, government restrictions, epidemic, pandemic, industrial dispute, technical problems with transport, machinery or equipment, power failure, natural or nuclear disaster, fire, flood, drought, adverse weather conditions and level of water in rivers.
In the event of a Force Majeure, we shall not be held responsible for any failure or delay providing any services which may or may not be already booked and / or confirmed by us. We will not be liable for any cost, losses, expenses, damages or refund of any amount in any way incurred by you due to an event of Force Majeure.

PRIVACY

All information provided to us for the purposes of booking and in process thereof shall be utilized, stored and disposed of in compliance to our Privacy Policy which can be found here and the same in incorporated herein.

SEVERABILITY

If any provision of these Terms and Conditions are rendered inoperative or void by operation of law, regulation, judgment or otherwise, such provision will be deemed omitted and the remainder of the Terms and Conditions will remain enforceable to the maximum permissible extent.

DISCLAIMER

We have made all reasonable efforts to check the accuracy of the information contained in our Web site. We cannot however accept any responsibility for any errors or omissions that may appear in this site.

GOVERNING LAW

If any dispute arises in relation to the agreement between you and us as constituted by these Terms and Conditions or otherwise, the laws of India will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts in Mumbai and waive any right that you may have to object to an action being brought in those courts.

You / Traveller / User hereby agrees to waive any rights to challenge the validity or enforceability of these Terms and Conditions on the ground that the agreement created by acceptance of these Terms and Conditions was made electronically.
